For the purpose of this Legal notice the following definitions apply:
- Web MARIONA.ES: The set of web pages that make up the website published under the domain name mariona.es and its sub domains.
- User: Physical person that has provided personal information through any web form or who access Web.
- Visitor: Physical person that has not provided personal information through any web form but who access contents published in the public area of the Web.
- Content: Pictures, videos and information related to MARIONA and its products promoted on the Web as well as the opinions and information posted by MARIONA through the Blog.

- Private Area: Pages of the Web which access is limited to the registered Users. Through this Area Users can submit and manage their orders.

MARIONA BAULENAS, S.L. is a Spanish society, with its registered office at Spain, Barcelona, Benet i Mateu street, 48-50, e-mail email@example.com, Registered in the Barcelona Commercial Register, in Volume 32279, Folio 51, Page B 205293, registration and VAT number B-62.165.808
Through its Web, MARIONA BAULENAS, SL provides information about products it sells, where its stores are located and information about news features and news trends in the fashion world through the Blog.
When submitting your first order, you shall create an account. Through this account the User will access the Private Area where she/he will be able to manage her/his personal data and her/his orders, returns and vouchers, as well as she/he will be able to configure and manage her/his gift lists.
4. Intellectual Property Rights
The entire Web: text, images, buttons, software files, color combinations, and the structure, selection, arrangement and presentation of content are protected by Spanish and International Laws on copyright.
In no case allowing access to the Web imply any waiver, total or partial transfer or assignment of the rights granted by Spanish and International legislation on copyright. Therefore, reproduction (except the temporary download from the website to the hard disk of the user or proxy servers), copying, use, distribution, reuse, making second copies, sending by email, transmission, modification, disposal or any other act realized with all or part of the information included in the Web that is not expressly authorized by the stakeholder of the copyright is prohibited.
MARIONA BAULENAS, SL is the stakeholder of the copyright or holds the necessary licenses of all the elements that build up the Web to use them through it. The author of the original design of the Web is PolCoder. Advertis Global, SL has adapted this original design and developed the Web and has assigned the copyright to MARIONA BAULENAS, SL.
Regarding the Contents posted via Blog, MARIONA grants to Visitors a license that enables them to use and spread them under the following conditions:
- Any use of the Content will require the identification of the author.
- The use of the Content for commercial purposes is prohibited.
- Transforming the Content is not allowed in order to create a derivative work.
Regarding the comments posted on the Blog by a User which may be considered as a literary creation, the User warrants that she/he is the author and that she/he holds, therefore, all the exploitation rights. The User grants a user license over these comments non-exclusive, unlimited, worldwide and nontransferable to publish and spread them through the Blog.
5. Industrial Property Rights
The brands and logos that appear in the Web are protected by Spanish and International Intellectual Property Laws.
Identifying logos of MARIONA are owned by MARIONA. By publishing those logos in the Web MARIONA does not authorize the use of them by Users and Visitors of the Web beyond what is necessary to reproduce the content of the Web.
Distinctive signs that identify third parties as well as their goods and services are owned by these third parties, so that MARIONA does not grant any license to Users and Visitors of the Web, who should only use them in order to reproduce the content of the Web.

7. Obligations and Liability
A. Responsibility for Content
Information relating to products marketed through the Web are sold "ad corpus" without express or implied warranties about them except legally established.
MARIONA has implemented measures to assure Users that the Web contents are maintained and do not contain incorrect or outdated information about the date of its publication on the Web (and, to the extent practicable thereafter).
MARIONA does not accept liability resulting from misuse of the Content, and disclaims any liability for damages that may be caused to the User or Visitor while using the Content. MARIONA does not warrant that the Content posted on the Blog, will be updated and will remain unmodified after publication.
MARIONA reserves the right to update, delete, limit or prevent access to the Content, in a temporal or permanent way. Any of these possible changes shall not grant to the User or Visitor the right to compensation and shall not include any recognition of any liability by MARIONA.
B. Responsibility for the Users comments
MARIONA assumes no responsibility for the comments made by Users in the Blog. The fact that the comments are posted on the Blog does not imply that MARIONA will share them or endorse them.
MARIONA will proceed to the removal of those comments if it should be deemed that they are contrary to the law or if it should be considered that they infringe the property or rights of a third party or if they violate the following principles:
a) The protection of public order, criminal investigation, public security and national defense
b) The protection of public health or the natural or legal persons who are consumers or users, even when acting as investors
c) Respect for the dignity and the principle of non-discrimination on grounds of race, sex, religion, nationality, disability or any other personal or social circumstance

e) The protection of intellectual property rights
f) Do not use pornographic images or pornographic content.
Therefore, in the event that a User or Visitor considers that any comment posted on the Blog infringe the foregoing principles, she/he may notify MARIONA, sending an e-mail to firstname.lastname@example.org, so MARIONA would be able to delete this comment whether it considers that it violates the principles above mentioned.
C. Responsibility for links to Third-party content
Providing links to websites from other individuals, organizations or companies do not imply MARIONA has any control over the content of these other websites. If the User or Visitor becomes aware that any of these contents may be contrary to law or may injure the property or rights of a third party or any of the principles listed in paragraph B, she/he may notify MARIONA, sending an e-mail to email@example.com, in order to cancel that link or undertake appropriate action.
Regarding links to the MARIONA profiles in different social networks, contents included in these profiles to which the User will get access, will be submitted to the social network terms and conditions or to the MARIONA terms and conditions published in that social network, if it would be the case.
Some of the links to websites from other individuals, organizations or companies may have been introduced by the author of the comment as part of its content. MARIONA declines any liability resulting from the content of these other websites. In the case that the Visitor or User realizes that these contents may be contrary to the law or may injure the property or rights of a third party or any of the principles listed in paragraph B, the Visitor or User may notify MARIONA, sending an e-mail to web firstname.lastname@example.org, in order to cancel the comment that contains the link or undertake appropriate action.
D. Disclaimer about technical aspects
Although MARIONA tries to do everything possible to ensure continued access to the Web, the dynamic nature of the Internet and its contents may not allow the Web operate without interruptions or discontinuities due to the need for website updates. Therefore, MARIONA will not be able to guarantee the continuity of the Web, or that it shall be operational and available at any time, nor that it will be free of errors or runs without errors due to internet connection. If the User notices a problem while using the Web, she/he may notify to MARIONA sending an e-mail to email@example.com, indicating the subject WEB EVENT.
MARIONA shall not be liable for any direct or indirect damages, including damage to computer systems or introduction of existing viruses on the network, derived from the Internet browsing, necessary for the visit and use of the Web. So MARIONA declines any liability for any damage or loss resulting from a denial of service attack, viruses or any other damaging and harmful software or other technological material that may affect the User’s electronic equipments or devices, data or materials as a consequence of browsing the web or downloading content thereof or redirect it.
E. User and Visitors obligations
User or Visitor shall be deemed liable for the damages that MARIONA may suffer as a result of breach of any of the obligations specified in this Legal notice.
Users and Visitors are fully responsible for their behavior when accessing the Web, while browsing and after accessing. Therefore, they are the sole responsible in front of MARIONA and third parties of the consequences that may result from:
- Use of Contents with illegal effects or contrary to this Legal Notice;
- The use of the Web with harmful effects to the interests or rights of third parties, or
- The use of the Web that in any way could damage, disable or impair the website or its services or impede the normal enjoyment thereof by other users.
The User or Visitor must not make improper use of the Web by the deliberate introduction into it of virus, Trojans, worms, logic bombs or any other program or technologically harmful or harmful material. Neither the user nor the Visitor will attempt to gain unauthorized access to the Website, to the server on which the site is staying or to any server, computer or database connected to the Web. MARIONA may revise this Legal notice from time to time as a result of legislation, jurisprudence or business practice modifications.

MARIONA may terminate, suspend or unilaterally terminate the operation of the Web and the user shall not seek compensation.
10. Governing Law and Jurisdiction
This Legal notice will be governed by Spanish law.
Expressly waiving their own jurisdiction to the extent that applicable law so permits Users, Visitors and MARIONA submit all interpretations or conflicts that could arise from this Legal notice to the Courts of Barcelona city.
